Representation

 

A local resident has queried why a condition could not be imposed to prevent future occupants applying for a parking permit and has provided an example.

 

Officer Comment

 

Officers do not consider that any pressure on local parking from future occupants would result in a highway safety issue or warrant sufficient grounds to refuse planning permission.

 

Notwithstanding this, if Members considered that this was a significant issue, and having researched this further, it is apparent that some local authorities have used planning conditions. I am also aware of situations where conditions have not been deemed appropriate by Planning Inspectors. If Members deemed this was necessary officers would need to explore this further.

 

In terms of Section 106 agreements, recent case law has judged that this is not the appropriate mechanism.

 

Otherwise, Members could seek to address this through instructions to the Parking Service Manager.
