Maidstone Borough Local Plan Adoption Statement

Adoption Date: 27 September 2017

 

Notice is hereby given in accordance with Regulations 26 and 35 of The Town and Country Planning (Local Planning) (England) Regulations 2012 (as amended) and pursuant to Section 23(3) of the Planning and Compulsory Purchase Act 2004 that the Maidstone Borough Local Plan was formally adopted by Maidstone Borough Council on 27 September 2017.

 

The Maidstone Borough Local Plan replaces all policies of the Maidstone Borough-Wide Local Plan 2000 that were saved in 2007, the Affordable Housing Development Plan Document 2006, the Open Space Development Plan Document 2006, and the Sustainable Construction Supplementary Planning Document 2006.

 

The Local Plan was the subject of an independent examination conducted by Mr Robert Mellor, an Inspector appointed by the Secretary of State for Communities and Local Government.  The examination included public hearing sessions which commenced on 4 October 2016 and ended on 24 January 2017.  The Inspector’s report was issued on 27 July 2017 and he concluded that the Local Plan is legally compliant and, with recommended main modifications, the Plan is sound.

 

The Maidstone Borough Local Plan, the Policies Map, the Adoption Statement and the Sustainability Appraisal (incorporating the Strategic Environmental Assessment) can be viewed and downloaded from the Council’s website at www.maidstone.gov.uk/localplan and paper copies of the documents can be inspected at the following locations:

Any person aggrieved by the adoption of the Local Plan may make an application to the High Court under Section 113 of the Planning and Compulsory Purchase Act 2004 on the grounds that the document is not within the appropriate power of the local planning authority and/or that a procedural requirement has not been complied with.  Any such application must be made no later than the end of the period of six weeks from the date the Local Plan was adopted.
